About these terms
These terms are an agreement between you and [OPERATOR_NAME not set] ([OPERATOR_ADDRESS not set], [OPERATOR_EMAIL not set]), the operator of Open Talk at https://open-talk.cz. By registering or using the service you accept them. Please read the Privacy Policy too.
Who can use Open Talk
- You must be at least 16 years old.
- You must give a real email address that you control.
- You may have an account for yourself only. You are responsible for what happens under your account, so keep your password safe.
Your content
- You own what you write. By posting, you give us a free, worldwide permission to store it, show it on the site and in its public pages, and let search engines index it, for as long as it is online.
- Posts and replies are public and plain text. Links in posts open other websites. We are not responsible for them.
- You promise that you have the right to post what you post.
Rules
You may talk about anything, but you may not use Open Talk to:
- post illegal content, or content that encourages crimes;
- threaten, harass, stalk or abuse other people, or spread hate against people for who they are;
- publish other people's private data without their consent;
- pretend to be someone else, or mislead people about who you are;
- send spam, advertising nobody asked for, or repeated copies of the same post;
- try to break, overload or get around the security of the service, or collect other users' data in bulk;
- break the rights of others, for example copyright.
Reports and moderation
- You can report any post, reply or profile with the Report link. Our admins look at reports. We cannot promise to tell you the outcome.
- If you think content is illegal, use the Report link and choose "Illegal content", or write to [OPERATOR_EMAIL not set] with where to find it, why you think it is illegal, and who you are. We look at such notices carefully and act in good time.
- Admins may edit or remove content, and suspend or delete accounts, when these rules are broken or the law requires it.
- When we remove content or suspend an account, we tell the person affected and give the reason. A suspended person sees the reason and the end date when they try to log in.
- If you disagree with a decision, write to [OPERATOR_EMAIL not set]. A person will look at it again. You may also use any right you have under the law, including going to court.
Ending your account
- You can delete your account at any time in Settings. What happens to your data is described in the Privacy Policy.
- We may suspend or end your account if you seriously or repeatedly break these terms, as described above.
The service
- Open Talk is provided as it is. It is a new service and may change, have errors, be unavailable, or lose data. Keep your own copy of anything you cannot lose (Settings lets you download your data).
- We may pause features such as registration, posting or replies, or make the whole site read-only, for example to deal with abuse or to do maintenance.
Liability
Nothing in these terms limits liability that cannot be limited by law, including for intent, gross negligence, injury to life, body or health, or consumer rights you have under mandatory law. Otherwise, to the extent the law allows, we are not liable for losses that were not reasonably foreseeable, for content written by users, or for things outside our control.
Changes
We keep every version of these terms. When we make a big change, we ask you to accept the new version the next time you log in. If you do not accept, you can delete your account.
Applicable law and courts
These terms follow the law of the EU member state where [OPERATOR_NAME not set] is established ([OPERATOR_ADDRESS not set]), without taking away protection you have as a consumer under the mandatory law of the country where you live. Disputes go to the courts of that member state, unless mandatory consumer law gives you the right to use the courts where you live.
